You are “grandfathered” from some provisions, like the siting and installation requirements. All wells that were in existence prior to October 2, 2013 must still comply with the Water Supply Certificate (in the case of drinking water wells), Water Quality Testing, and Decommissioning provisions of the regulation.


In addition, if any repairs or upgrades are performed to the well, except replacement of a defective pump, the well must be brought into compliance with the applicable provisions of the Well Construction section of the regulation.
